According to California laws, a person can be charged with first-degree burglary if they break into an inhabited dwelling, even if nobody is inside the dwelling at the time of the crime.  This could result in a felony conviction punishable by up to six years in jail, fines, probation, and restitution to any victims.  A second-degree burglary can be charged when a case does not qualify as first-degree burglary and is considered a misdemeanor or a felony that can be punished by up to three years in prison, along with fines and probation.
