Murder and Manslaughter

In California, the Penal Code defines murder as “The unlawful killing of a human being, or a fetus, with malice aforethought” (Section 187). Depending on your case, murder is categorized as either first or second degree. First degree murder refers to murder that is willful, deliberate, and premeditated. Murder can also be categorized as first degree if it is committed with another violent felony. Second degree is all other murder cases that are not committed with another violent felony. Manslaughter refers to causing a death without premeditation. There are three different types of manslaughter: voluntary, involuntary and vehicular. Voluntary manslaughter refers to a murder that occurs intentionally during a heat of passion. Involuntary manslaughter occurs when a person kills someone while also committing another non-felony crime or through carelessness. Vehicular manslaughter is when a person is killed with a vehicle or during an accident.

This includes murder for hire, killing a police officer, or killing a child under the age of 6.
